These Terms of Use (the "Terms") are a binding contract between You and SafeTalks ("Company, SafeTalks," "we", "our" and "us"). You must agree to and accept all of the Terms, or you don't have the right to use the Services. Your using the Services in any way means that you agree to all of these Terms, and these Terms will remain in effect while you use the Services. These Terms of Use constitute an electronic record within the meaning of the Information Technology Act, 2000 and the rules framed thereunder, including the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021 (as amended or re-enacted from time to time). By accessing, browsing, or otherwise using this Website, the user acknowledges and agrees that these Terms of Use are legally binding and enforceable under applicable Indian laws. The user’s continued use of the Website signifies their consent to be bound by these Terms and constitutes valid acceptance.

  1. Our Services:

SafeTalks is an emotional support and peer-listening platform designed to provide a safe space for individuals to share their thoughts and feelings. SafeTalks do not provide medical, psychiatric, psychological, therapeutic, or clinical services of any kind. We are not a hospital, medical services provider, crisis helpline, or mental health care institution.

Our listeners are empathetic peers and are not licensed psychologists, psychiatrists, counselors, therapists, doctors, or other medical professionals. Any support offered through the platform is intended solely for emotional support and general well-being and must not be construed as medical advice, diagnosis, treatment, or therapy.

SafeTalks is not equipped to handle emergencies or crisis situations. If you are experiencing a mental health emergency, severe distress, or suicidal thoughts, you are strongly advised to seek immediate assistance from qualified mental health professionals, emergency services, or local crisis helplines. SafeTalks shall not be responsible for outcomes arising from reliance on the services provided through the platform in such circumstances.

  1. Who are SafeTalks Empathetic Peers?

"Empathetic Listener" (hereinafter referred to as "Listener," "Companion," or "Peer Supporter") refers to an individual user, volunteer, or independent contractor authorized by the Platform to engage in text-based or voice-based communication with other Users for the sole purpose of providing emotional support, active listening, and companionship.

The User acknowledges and agrees that an Empathetic Listener:

  1. Non-Clinical Role: Is acting solely in a peer-to-peer capacity and is not a licensed medical professional, psychologist, psychiatrist, clinical social worker, or emergency responder, unless explicitly verified and designated as such by the Platform.
  2. Scope of Services: Provides services limited to active listening, validation, and general emotional encouragement ("Peer Support"). The Listener does not provide medical diagnoses, clinical therapy, prescription of medication, legal advice, or crisis intervention.
  3. No Professional Relationship: Does not establish a doctor-patient, therapist-client, or attorney-client relationship with the User. Any insights, feedback, or conversation offered by the Listener constitute personal opinion and subjective perspective, not professional advice.
  4. Subjective Nature: Relies on personal empathy and life experience to support the User. The Platform does not guarantee that the Listener's responses will be objectively correct, effective, or suitable for the User’s specific mental health needs.

Limitation of Liability (Empathetic Listener Services)


(i) No Professional Reliance : To the fullest extent permitted by applicable law, [SafeTalks] (the "Platform") expressly disclaims any liability for the accuracy, reliability, or effectiveness of the support provided by Empathetic Listeners. The User acknowledges that the Platform is an intermediary connecting Users with Listeners and does not control the specific content of the conversations. The User agrees that any reliance on the information, advice, or suggestions provided by an Empathetic Listener is solely at the User's own risk.

(ii) Medical and Crisis Disclaimer : The Platform and its Empathetic Listeners are not authorized to handle medical emergencies or crisis situations, including but not limited to suicide ideation, self-harm, domestic abuse, or severe psychiatric episodes. In the event of a medical or psychological emergency, the User agrees to immediately discontinue use of the Platform and contact qualified emergency services (e.g., 112 in India, 911 in the US) or a certified medical professional. The Platform shall not be held liable for any injury, death, or damages resulting from the User’s failure to seek appropriate professional medical treatment.

(iii) Acts of the Listener : While the Platform makes reasonable efforts to screen and train Listeners, the Platform does not guarantee the conduct, character, or suitability of any specific Empathetic Listener. The Platform explicitly disclaims liability for:

(a) Any emotional distress, anxiety, or worsening of mental health conditions alleged to be caused by a conversation with a Listener;

(b) Any offensive, inappropriate, or negligent comments made by a Listener that violate the Platform’s code of conduct;

(c) Any actions taken by the User based on the conversation with the Listener.

(iv) "As Is" Basis : The emotional support services are provided on an "AS IS" and "AS AVAILABLE" basis. The Platform makes no guarantee that the services will meet the User’s specific requirements or that the Empathetic Listener’s availability will be uninterrupted, timely, or error-free.

  1. Privacy

SafeTalks values your trust. In order to honor that trust, SafeTalks adheres to ethical standards in gathering, using, and safeguarding any information you provide.

If You do not agree with these Terms or the Privacy Policy, please do not use the Website/application or avail the Services or products. Any access to our Services/Website/products through registrations is nontransferable.

  1. Intellectual Property

Except as mentioned below, all information, content, material, trademarks, services marks, trade names, and trade secrets including but not limited to the software, text, images, graphics, video, script and audio, contained on the Website, Application, Services and products are proprietary property of the Company (“Proprietary Information”). No Proprietary Information may be copied, downloaded, reproduced, modified, republished, uploaded, posted, transmitted or distributed in any way without obtaining prior written permission from the Company and nothing on this Website or Services shall be or products deemed to confer a license of or any other right, interest or title to or in any of the intellectual property rights belonging to the Company, to the User.

Certain contents on the Website may belong to third parties. Such contents have been reproduced after taking prior consent from said party and all rights relating to such content will remain with such third party.

  1. User Account and Registration

You will be required to create and register an account on SafeTalks in order to interact with SafeTalks Empathetic Peers and to avail of the Services. As part of the registration process, you will be required to submit certain personal details as specified in our Privacy Policy. You agree and undertake to provide accurate, complete, and up-to-date information during registration and to keep such information current at all times. You acknowledge that the collection, use, storage, and processing of your personal data shall be governed by the Privacy Policy. You may not transfer, assign, or share your account with any other person without our prior written permission.

  1. Eligibility and Age Restrictions

By accessing or using the Platform, you represent and warrant that you are at least eighteen (18) years of age, legally competent to enter into a binding contract, and are using the Platform solely for the purpose of seeking empathetic, non-clinical conversation and emotional support.

The Platform and Services are intended exclusively for adults. Individuals under the age of eighteen (18) are not permitted to access or use the Platform under any circumstances. We do not knowingly offer Services to minors, and parental or guardian consent does not permit use of the Platform by persons below eighteen (18) years of age.

By using the Platform, you further represent that you understand the nature and limitations of the Services, and acknowledge that the Platform does not provide medical, psychological, psychiatric, or crisis intervention services.

  1. Permitted Use of Services

Your use of our products, Website and Services is solely for Your personal and non-commercial use. Any use of the Website, Services or products or their contents other than for personal purposes is prohibited.

  1. User Conduct and Prohibited Activities

To maintain SafeTalks as a respectful, secure, and supportive space, every user agrees NOT to engage in any of the activities listed under clauses (a) to (r):

a) Making available any content that is misleading, unlawful, harmful, threatening, abusive, tortious, defamatory, libelous, vulgar, obscene, child-pornographic, lewd, lascivious, profane, invasive of another's privacy, hateful, or racially, ethnically or otherwise objectionable;

b) Attempt to contact empathetic peers outside the SafeTalks platform;

c) Stalking, intimidating and/or harassing another and/or inciting other to commit violence;

d) Transmitting material that encourages anyone to commit a criminal offence, that results in civil liability or otherwise breaches any relevant laws, regulations or code of practice;

e) Interfering with any other person's use or enjoyment of the Website/Services;

f) Making, transmitting or storing electronic copies of materials protected by copyright without the permission of the owner, committing any act that amounts to the infringement of intellectual property or making available any material that infringes any intellectual property rights or other proprietary rights of anyone else;

g) Make available any content or material that You do not have a right to make available under any law or contractual or fiduciary relationship, unless You own or control the rights thereto or have received all necessary consents for such use of the content;

h) Impersonate any person or entity, or falsely state or otherwise misrepresent Your affiliation with a person or entity;

i) Post, transmit or make available any material that contains viruses, trojan horses, worms, spyware, cancelbots, or other computer programming routines, code, files or such other programs that may harm the Website/services, interests or rights of other users or limit the functionality of any computer software, hardware or telecommunications, or that may harvest or collect any data or personal information about other Users without their consent;

j) Access or use the Website/Services/products in any manner that could damage, disable, overburden or impair any of the Website's servers or the networks connected to any of the servers on which the Website is hosted;

k) Intentionally or unintentionally interfere with or disrupt the services or violate any applicable laws related to the access to or use of the Website/Services/products, violate any requirements, procedures, policies or regulations of networks connected to the Website/Services/products, or engage in any activity prohibited by these Terms;

l) Disrupt or interfere with the security of, or otherwise cause harm to, the Website/Services/products, materials, systems resources, or gain unauthorized access to user accounts, passwords, servers or networks connected to or accessible through the Website/Services/products or any affiliated or linked sites;

m) Interfere with, or inhibit any user from using and enjoying access to the Website/ Services/products, or other affiliated sites, or engage in disruptive attacks such as denial of service attack on the Website/Services/products;

n) Use deep-links, page-scrape, robot, spider or other automatic device, program, algorithm or methodology, or any similar or equivalent manual process, to increase traffic to the Website/Services/products, to access, acquire, copy or monitor any portion of the Application /Website/Services/products, or in any way reproduce or circumvent the navigational structure or presentation of the Application, or any content, to obtain or attempt to obtain any content, documents or information through any means not specifically made available through the Website/Services/products;

o) Alter or modify any part of the Services;

p) Use the Services for purposes that are not permitted by: (i) these Terms; and (ii) any applicable law, regulation or generally accepted practices or guidelines in the relevant jurisdiction; or

q) Violate any of the terms specified under the Terms for the use of Website/Services/products

r) Solicit or promote any products or services during a session;

A violation of any of the foregoing is grounds for termination of your right to use or access the Services.

Medical Disclaimer

We do not provide Medical or Professional Advice. The Services cannot and are not intended to provide medical advice. We advise you to always seek the advice of a physician or other qualified healthcare provider with any questions regarding your personal health or medical conditions. Never disregard, avoid, or delay in obtaining medical advice from your doctor or other qualified healthcare provider because of something you have read on the Site. If you have or suspect that you have a medical problem or condition, please contact a qualified healthcare professional immediately.

NO LICENSED MEDICAL PROFESSIONAL/PATIENT RELATIONSHIP IS CREATED BY USING INFORMATION AND/OR SERVICES PROVIDED BY OR THROUGH THE USE OF THE SITE OR THROUGH ANY OTHER COMMUNICATIONS FROM US. THE CONTENT OF THE SITE AND THE SERVICES ARE NOT AND SHOULD NOT BE CONSIDERED MEDICAL ADVICE OR A SUBSTITUTE FOR INDIVIDUAL MEDICAL ADVICE, DIAGNOSIS OR TREATMENT.   1. Pricing, Payments, & Refunds

Prices for sessions may be revised from time to time. Any applicable pricing and discounts will be clearly communicated to users prior to booking and published on the SafeTalks website. SafeTalks is currently offering a 50% discount on each session for a limited period. This promotional offer is valid only for the duration specified (31st March 2026) and may be modified or withdrawn at any time. Any changes to pricing or promotional offers will be updated on the website and communicated to users before a session is booked.

All sessions must be booked and paid for in advance. Users may cancel a scheduled session up to 24 hours prior to the session time to receive a full refund. Cancellations made within 24 hours of the scheduled session, or failure to attend a session without prior notice (“no-show”), will not be eligible for any refund.

Happiness Promise – Full Money-Back Guarantee: If a user is not satisfied with the session and does not feel emotionally relieved after the session, the user may request a refund for that session by notifying the SafeTalks team within twenty four (24) working hours from the completion of the session. Refund requests received after this period shall not be considered, and SafeTalks reserves the right to deny such requests. This guarantee applies only to the specific session in question and is subject to verification in accordance with SafeTalks’ internal refund policies.

  1. Operating Hours and Session Length

SafeTalks currently operates during limited hours, which shall be communicated on the website and booking platform from time to time. We are working towards providing services on a 24×7 basis in the future. Any changes to operating hours, including the introduction of round-the-clock services, will be updated on the website and shall apply prospectively.

Sessions are currently offered with a minimum duration of 30 minutes, and users will be charged accordingly. SafeTalks may introduce shorter session durations and revised pricing in the future, until such changes are implemented, the minimum billable session length shall remain 30 minutes. If a session exceeds the booked duration, the user will be informed once the allotted time has ended and may choose to continue the session. Any additional time beyond the booked session duration will be charged at ₹21 per minute, subject to the user’s express confirmation.

  1. Limitation of Liability

To the fullest extent permitted by applicable law, SafeTalks and its parent company shall not be liable for any emotional outcomes, personal decisions, actions, or consequences arising from or related to the use of the services. SafeTalks shall also not be responsible for any service disruptions, technical issues, or interruptions beyond its reasonable control. In all circumstances, SafeTalks’ maximum aggregate liability, whether in contract, tort, or otherwise, shall be strictly limited to the amount paid by the user for the specific session giving rise to the claim.

13. Third Party Links and Services

The Services may contain links or connections to third party websites or services that are not owned or controlled by SafeTalks. When you access third party websites or use third party services, you accept that there are risks in doing so, and that SafeTalks is not responsible for such risks. We encourage you to be aware when you leave the Services and to read the terms and conditions and privacy policy of each third party website or service that you visit or utilize.

SafeTalks has no control over, and assumes no responsibility for, the content, accuracy, privacy policies, or practices of or opinions expressed in any third party websites or by any third party that you interact with through the Services. In addition, SafeTalks will not and cannot monitor, verify, censor or edit the content of any third-party site or service. By using the Services, you release and hold us harmless from any and all liability arising from your use of any third-party website or service.

  1. Modifications of Terms

    We are constantly trying to improve our Services, so these Terms may need to change along with the Services. When you use any of the services provided by the platform, you will be subject to the rules, guidelines, policies, terms and conditions applicable to such service, and they shall be deemed to be incorporated into these terms of use and shall be considered as part and parcel of these terms of use. We reserve the right, at our sole discretion, to change, modify, add or remove portions of these terms of use, at any time without any prior written notice to you. It is your responsibility to review these terms of use periodically for updates, we change. Your continued use of the website following the posting of changes will mean that you accept and agree to the revisions.

    If you do not agree with the new Terms, you are free to reject them; unfortunately, that means you will no longer be able to use the Services. If you use the Services in any way after a change to the Terms is effective, that means you agree to all of the changes.

    Except for changes by us as described here, no other amendment or modification of these Terms will be effective.

  2. Indemnification

You agree to defend, indemnify and hold harmless the Company, its officers, directors, employees and agents, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney’s fees) arising from: (i) Your use of and access of the Website/Services; (ii) Your violation of any term of these Terms or any other policy of the Company; (iii) Your violation of any third party right, including without limitation, any copyright, property, or privacy right; or (iv) any claim that Your use of the Website/Services has caused damage to a third party; (v) damage (physical, financial, mental or any other kind) cause to self or other. This defense and indemnification obligation will survive these Terms.

In no event shall the Company, its officers, directors, employees, partners or agents be liable to You or any third party for any special, incidental, indirect, consequential or punitive damages whatsoever, including those resulting from loss of use, data or profits or any other claim arising out, of or in connection with, Your use of, or access to, the Services

  1. Confidentiality

You shall be responsible for maintaining the confidentiality of the account information and for all activities that occur under Your account. You agree to (a) ensure that You successfully log out from Your account at the end of each session; and (b) immediately notify the Company of any unauthorized use of Your account. If there is reason to believe that there is likely to be a breach of security or misuse of Your account, we may request You to change the password or we may suspend Your account without any liability to the Company, for such period of time as we deem appropriate in the circumstances. We shall not be liable for any loss or damage arising from Your failure to comply with this provision.

  1. Assignment

You may not assign, delegate or transfer these Terms or your rights or obligations hereunder, or your Services account, in any way (by operation of law or otherwise) without SafeTalks prior written consent. We may transfer, assign, or delegate these Terms and our rights and obligations without consent.

18. Governing Law and Jurisdiction

The Terms shall be governed by and construed in accordance with the laws of India, without regard to conflict of law principles. Further, the Terms shall be subject to the exclusive jurisdiction of the competent courts located in Gurgaon, Haryana and You hereby accede to and accept the jurisdiction of such courts.

  1. Severability

If any provision of these Terms of Use is found to be unenforceable or invalid under any applicable law, such unenforceability or invalidity shall not render these Terms of Use unenforceable or invalid as a whole, and such provisions shall be deleted without affecting the remaining provisions herein.

  1. Force Majeure

SafeTalks shall not be liable for any delay or failure to perform resulting from causes outside its reasonable control, including, without limitation, any failure to perform hereunder due to unforeseen circumstances or causes beyond SafeTalks’ control such as natural disasters, war, terrorism, riots, embargoes, pandemic, acts of civil or military authorities, fire, floods, accidents, strikes or shortages of transportation facilities, fuel, energy, labour or materials.
